4. Forensic Services — Engagement Terms

4.1  Scope of service

All forensic engagements are conducted strictly within the scope agreed in writing between Deepdive Forensic Labs and the Client at the time of engagement. No forensic analysis, report, or expert declaration will be provided in relation to materials not covered by the agreed scope without a separate written instruction.

4.2  Client obligations

By commissioning a forensic engagement, you represent and warrant that:

  • You are authorised to submit the materials provided to us for forensic analysis.
  • The submission of those materials does not breach any applicable law, court order, confidentiality obligation, or third-party right.
  • The information you provide to us in connection with the engagement is accurate and complete to the best of your knowledge.
  • You will use the forensic reports and findings we produce only for lawful purposes.

4.3  Nature of forensic findings

Our forensic reports represent the professional opinion of our analysts based on the evidence available at the time of analysis. A forensic finding is not a guarantee or absolute determination of authenticity or manipulation — it is a scientifically grounded assessment with a stated confidence level.

Deepdive Forensic Labs does not accept liability for decisions made by clients, courts, regulatory bodies, or third parties in reliance on our forensic findings. The weight to be given to a forensic report in any legal or regulatory proceeding is a matter for the relevant authority.

4.4  Turnaround times

Indicative turnaround times provided at the time of engagement are estimates only and are not contractually binding unless expressly stated in a written engagement agreement. We will inform you promptly of any material delay.

4.5  Engagement fees

Fees for forensic engagements are agreed in writing prior to commencement. We reserve the right to withhold delivery of a forensic report until payment has been received in full, unless alternative arrangements have been agreed in writing.

5. Intellectual Property

5.1  Our intellectual property

All content on deepdiveforensics.ai — including but not limited to text, graphics, logos, icons, images, methodology descriptions, and software — is the property of Deepdive Forensic Labs or its licensors and is protected by applicable Indian and international intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any content from this Site without our prior written consent.

5.2  Forensic reports

Forensic reports, heatmaps, spectrograms, expert declarations, and other deliverables produced by Deepdive Forensic Labs in connection with a forensic engagement are produced for the specific use of the commissioning client in the context of the stated engagement. They may not be reproduced, published, or disclosed to third parties without our prior written consent, except as required for the purposes of the legal or regulatory proceeding for which they were commissioned.

5.3  Submitted materials

You retain ownership of any media files, documents, or materials you submit to us for forensic analysis. By submitting materials, you grant Deepdive Forensic Labs a limited, non-exclusive licence to use those materials solely for the purpose of conducting the forensic analysis you have commissioned.

6. Confidentiality

Deepdive Forensic Labs treats all case materials, client information, and forensic findings as strictly confidential. We will not disclose any information relating to your engagement to any third party except:

  • Where you have given us explicit written authorisation to do so.
  • Where disclosure is required by a valid court order, legal process, or regulatory direction under Indian law.
  • Where disclosure is necessary to prevent a serious and imminent risk to public safety.
  • To our professional advisors (legal counsel, auditors) who are subject to equivalent confidentiality obligations.

We require all personnel with access to case materials to be bound by confidentiality obligations. Our chain-of-custody protocols ensure that submitted materials are accessible only to the analysts assigned to your engagement.

7. Limitation of Liability

To the fullest extent permitted by applicable Indian law, Deepdive Forensic Labs shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services.
  • Any loss of data, revenue, profits, or business opportunity arising from reliance on our forensic findings.
  • Any failure or delay in delivering forensic services caused by circumstances beyond our reasonable control, including technical failures, force majeure events, or delays caused by the client.
  • Any decisions made by courts, regulatory bodies, employers, or other third parties in reliance on our forensic reports.

Our total liability to you in connection with any forensic engagement shall not exceed the fees paid by you for that specific engagement, except in cases of fraud or gross negligence on our part.

8. Indemnification

You agree to indemnify, defend, and hold harmless Deepdive Forensic Labs, its directors, employees, analysts, and agents from and against any claims, liabilities, damages, losses, and expenses — including legal fees — arising from:

  • Your breach of these Terms and Conditions.
  • Your submission of materials to which you did not have the right or authority to submit.
  • Your use of our forensic reports or findings for unlawful purposes.
  • Any claim by a third party arising from your use of our services.

We will endeavour to resolve any dispute through good-faith negotiation in the first instance. Where a dispute cannot be resolved informally, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from the remaining Terms and shall not affect the validity and enforceability of the remaining provisions, which shall continue in full force and effect.

15. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any written engagement agreement entered into between Deepdive Forensic Labs and a client, constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior discussions, representations, and agreements.
